ABSTRACT: In recent years, to ensure the inheritance, protection, and development of local traditional Chinese medicine (TCM), provinces across the country have successively formulated or revised TCM regulations, legislating around such aspects as local TCM services and regulation, protection and development, education and talent, as well as culture and communication. These regulations exhibit prominent characteristics, including attaching importance to talent cultivation and inheritance, promoting the popularization of TCM culture, facilitating the overseas dissemination of TCM culture, and emphasizing the protection of Chinese medicinal materials and industrial development. However, in the legislation of various provinces, there are still problems such as insufficient protection of intellectual property rights, overly simplistic provisions for industrial promotion, inadequate safeguard measures, and insufficient support. Therefore, based on local practices, strengthening the protection of local TCM intellectual property rights, refining provisions for industrial promotion, improving safeguard measures, and enhancing support will serve as references for most provinces in their next revision of the legislation.
