Abstract: |
Since the resuming of labor disputes system in 1987, China has successively promulgated the labor dispute handling regulations, labor law, trade unions, labor contract law, labor dispute mediation and arbitration law and other labor laws and regulations, and established the Chinese labor dispute settlement mechanism of " one mediation one arbitration and two trials”. It can be said that, labor dispute mediation and arbitration law has been well implemented in recent two years, which played an important role in effectively resolving of labor disputes and promotion of harmonious and stable labor relations. But with the economic and social development and change, this system has become non-adaptive in practice.
