Abstract: Says to some extent that environmental problem is a kind of unreasonable social result of reasonable behavior that personal pursuit for self-benefit. As the embodiment of democratic concept in environmental affairs, the public participate in EIA have the meaning that cannot be replaced. But in practice, public participation in the basic formality, greatly reducing the effectiveness of the implementation of environmental democracy. This article is based on the perspective of environmental laws, analysis the issues that arise during the implementation of the"Environmental Impact Assessment law" and other related regulatory and the corresponding countermeasures and suggestions in order to promote public participation in environmental impact assessment of the implementation, to achieve environmental justice.
