Abstract: With panel data of 27 regions between 2003 and 2008 inChina, the paper discusses that the level of intellectual property rights protection and human capital of R&D influence on the R&D level of foreign firms by means of grouping and constructing variables with multiplying under constraints of the level of intellectual property rights protection (IPR) and job mobility. The results show that intellectual property protection has a positive effect on the R&D level of foreign firms. High level of intellectual property rights protection makes human capital of R&D has a positive effect on the R&D level of foreign firms. Employment mobility makes human capital of R&D have a negative effect on the R&D level of foreign firms under low level of IPR protection; Employment mobility makes human capital of R&D have a positive effect on the R&D level of foreign firms under high level of IPR protection. Human capital of R&D has a negative effect on the R&D level of foreign firms under high level of employment mobility. Intellectual property protection makes human capital of R&D and has a positive effect on the R&D level of foreign firms.
